Class Action Complaint On Behalf of Employees of Airport Authority
On October 1, 2010, the Board of Administration adopted Board Resolution 2010-02 implementing the Fourth District Court of Appeal decision in City of San Diego v. San Diego City Employees’ Retirement System 186 Cal.App.4th 69 (2010).

The Board determined that the decision in this case applied equally to Members of the Airport plan because the rationale stated in the Court’s ruling applied equally to Airport Members.
On November 5, 2010, the Board of Administration adopted Board Rule 4.90 (PSC Corrections) setting forth the correction options for PSC Contracts affected by this case.
As a result of the Board’s implementation of corrections mandated by the Court of Appeal decision, SDCERS has now been sued in a class action lawsuit by Airport Authority employees as class representatives of Airport Members who are subject to the correction process.
