Public Employees Board Issues Ruling on Proposition B

The Public Employees’ Relations Board (PERB) this week issued its proposed ruling on the unions’ challenge to Proposition B, otherwise known as Comprehensive Pension Reform.  SDCERS is neither affiliated with nor involved in Proposition B or the PERB action.

PERB found that the City violated the Meyers-Milias-Brown Act requirement to meet and confer with employees before putting the Proposition B initiative on the ballot.  The ruling requires that the City rescind Proposition B and maintain the status quo of the defined benefit style pension system prior to the passage of Proposition B for all employees.  The ruling, which was served on February 11, 2013, becomes final unless the City files an exception within 20 days of its service. 

Because the City has not yet given its official position, it is too early to tell how it will impact City employees.  If the City files an exception within the time required, then SDCERS will continue to implement Prop B until there is a final judgment.  In that case, PERB’s ruling will not have an immediate impact on SDCERS’ operations.
